Fall sports games continued. Including tackle and flag football, fall soccer and cheerleading. 2. Adult activities at Pooler Park included Gaelic Football and the Hispanic Softball League. 3. PRD hosted 4 high school football games at Pooler Stadium. 4. The Community Center was rented each weekend in October. 5. Gymnastics and Dance classes continued. Registrations for both next sessions were open. 6. 6u basketball registration closed and practices began at the gyms on Rogers Street. 7. PRD hosted a karate tournament at the gym on Rogers Street. Senior Center 1. All daily classes and activities continued. 2. The monthly birthday party was a costume party for Halloween. 3. Seniors had the opportunity to visit the “Wall That Heals” Vietnam memorial in Hinesville. 4. Other day trips included Brooklet and Magnolia Springs State Park in Millen. 5. The center partnered with Coachlight Tours to offer an overnight trip to Cherokee, North Carolina. 6. The Rotary Club sponsored a fish fry at the center. Parks 1. FENCES, TO AMEND STANDARDS RELATED TO THE PERMITTING AND CONSTRUCTION OF FENCES; TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE FOR AN EFFECTIVE DATE, AND FOR OTHER PURPOSES NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of Pooler that the Code of Ordinances of the City of Pooler, Georgia are hereby amended as follows: I That CHAPTER 22 – BUILDINGS AND BUILDING REGULATIONS, ARTICLE IV – FENCES, be amended by deleting the strikethrough text and adding the underlined text as follows: Sec. 22-111. - Definitions. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Animal enclosure means an animal wire or chain link fence, with wood or metal posts with a minimum height of 4 feet and a maximum height of 6 feet as required. Commercial/security fence means a fence constructed of wrought iron or similar material, or vinyl coated galvanized chain link fencing material to include an all vinyl coated fence framework system. The vinyl coated fence and framework system shall be black or hunter green with a maximum height of eight feet. The minimum requirement for thickness shall be nine gauge which is defined as the total overall thickness to include the inner wire. Decorative or ornamental means a fence constructed of wood, vinyl, masonry and wrought iron or a combination thereof with a maximum height not to exceed 36 inches four feet and maximum 70 percent opaqueness. Fences. An artificially constructed barrier of any material or combination of materials that is at least two feet in height when measured from the grade directly below the fence, to enclose, screen, or separate areas. 1Industrial/security fence means a fence constructed of vinyl coated galvanized chain link fencing material, or wrought iron or similar material, with a maximum height of eight feet. to include an all vinyl coated fence framework system. The vinyl coated fence and framework system shall be black or hunter green with a maximum height of eight feet. The minimum requirement for thickness shall be nine gauge which is defined as the total overall thickness to include the inner wire. Residential fence Privacy means a fence constructed of wood or other material as appropriate to maintain aesthetic decor with a maximum height of six feet. Utility means a fence of chain link construction with wood or metal posts with a maximum height not to exceed four feet. Sec. 22-112. - Building permit; application. (a) A building permit issued by the administrative officer is required in advance of the construction or erection of a fence. (b) An application for a fence building permit will be accompanied by a simple sketch survey of the property or approved site plan delineating all property lines and easements and showing the dimensions (including height), type, material and location of the fence to be erected. If the fence is a decorative fence, the application shall include a front elevation and cross-sectional drawing of the fence, and the location of the fence and its relation to nearby buildings, utility easements and fire hydrants. Sec. 22-113. - Minimum standards. The minimum standards for fence construction shall be as follows: (1) Utility fences shall be restricted to the rear and side yards and shall not exceed the front yard or side yard setback line on the corner lot. (2) Barbed wire shall not be used above a utility fence. (3) Residential Privacy fences will be restricted to the rear and side yards and shall not exceed the front yard setback line. The side street setback line is included in this restriction. Residential fences for multi-family residential development are permitted to encroach in the front yard setback line but can be no closer than 15 feet from the front property line or side street property line. (4) See Chapter 14, section 14-4 for animal enclosure distance requirements for fences. Fenced animal enclosures are restricted to the rear and side yards and shall not exceed the front yard setback line. The side street setback line is included in this restriction. (5) Decorative or ornamental fences will not be restricted by setback lines. The construction approval must be obtained from the planning and zoning commission and the aldermanic board prior to the issuance of a building permit. (6) Commercial/security fences shall be allowed provided they do not exceed the dimensions set out in section 22-111. Setback restrictions shall apply for commercial uses or in the commercially zoned districts. Three strands of vinyl coated barbed wire to match the existing fence framework system shall be allowed 2 on top of a six-foot security fence but is not allowed on an eight-foot security fence. (7) Industrial/security fences shall be allowed provided they do not exceed the dimensions set forth in section 22-111. Setback restrictions shall not apply in the industrially zoned districts. Three strands of vinyl coated barbed wire to match the existing fence framework system shall be allowed on top of a six-foot security fence but is not allowed on an eight-foot security fence. (8) All fences shall be kept in good repair; and unless constructed of galvanized or non-corroding metal, shall be given a protective coating as necessary to maintain a clean appearance and safe condition. Sec. 214 – 216 – no changes Sec. 22-117. - Violation; penalty. Any person violating any provision of this article may be deemed guilty of an offense, and upon conviction shall be punished as provided in section 1-12. II All ordinances or parts of ordinances in conflict with the ordinance are hereby repealed. III If any section, clause, or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, the said holding shall in no way affect the validity of the remaining portions of this ordinance. IV This ordinance shall be effective immediately upon its adoption by the Mayor and City Council of Pooler, Georgia. The property is adjacent to multi-family and townhome developments, an undeveloped City- owned parcel, commercial development and pipemakers canal. The Pooler 2040 Comprehensive Plan identifies this area within the Commercial character area. The FLUM designates this site as Commercial. Relevant Ordinances: App. A, Art. IV, Sec. 19. Is this request a logical extension of a zoning boundary which would improve the pattern of uses in the general area? • Yes, the request is a logical extension of the C-2 zoning district as it is consistent with the nearby commercial uses and is currently zoned C-2 with a condition that it be used for a memory care center. 2. Is this spot zoning and generally unrelated to either existing zoning or the pattern of development of the area? • No, while there are properties directly adjacent to the subject site zoned R-3-B, R-4, and R-1-A the site is currently zoned C-2 with a condition that it be used as a memory care center. It does generally coincide with the pattern of commercial development in the area. 3. Could traffic created by the proposed use or other uses permissible under the zoning sought traverse established single-family neighborhoods on minor streets, leading to congestion, noise, and traffic hazards? • The proposed use is located with access on Benton Grove Road through the C-2 zoning district and other commercial and multi-family development. Any potential traffic impacts will be reviewed prior to final approval of any site or construction plans, if rezoned. 2 4. Will this request place irreversible limitations on the area as it is or on future plans for it? • No, the request would be consistent with adopted plans and policies for the area. The comprehensive plan and the future land use map identify the property as commercial and the proposed rezoning would maintain a commercial zoning district. 5. Is there an imminent need for the rezoning and is the property likely to be used for the use requested? • The property is likely to be utilized as requested. The adjacent uses are multi-family residential and commercial. The site was rezoned to commercial two years ago with the condition it only be used as a memory care center. The site has since remained undeveloped. 6. Will the proposed use substantially conflict with existing density patterns in the zone or neighborhood? • No, the proposed rezoning would be consistent with that of the general area being used for commercial and multi-family residential development. 7. Would the proposed use precipitate similar requests which would generate or accelerate adverse land use changes in the zone or neighborhood? • It is possible additional requests could be made to rezone other parcels in the vicinity to this zoning district. However, many of the surrounding parcels are in various development stages. There is one undeveloped parcel adjacent to the subject property which is owned by the City of Pooler and is currently zoned R-1-A. 8. Will the action adversely impact adjacent or nearby properties in terms of: o Environmental quality or livability resulting from the introduction of uses or activities which would create traffic, noise, odor or visual hazards or the reduction of light and air that is incompatible with the established development pattern? • No, the request may not adversely impact the nearby properties as it relates to environmental quality, livability, or cause incompatible development. The site is currently undeveloped, but it is zoned C-2 with a condition that the use be a memory care center. The impacts of a memory care center are similar to those of a hotel. 3 o Property values, by rendering such properties less suitable and therefore less marketable for the type of development to which they are committed or restricted in order to promote the public welfare and protect the established development pattern? • No, the request would not adversely impact the nearby properties as it relates to property values or make them less marketable because the proposed commercial use is compatible with the existing commercial uses in the area. o Will the action create development opportunities of such increased intensity that stormwater runoff from the site cannot be controlled within previous limits, with [which] results in adverse impacts upon existing down-stream drainage problems or potential problems? • No, the request would not adversely impact the nearby properties as it relates to stormwater runoff. Any future site development proposed will need to go through site plan review and approval to ensure items such as stormwater runoff are addressed on site so that down-stream drainage or off-site impacts do not occur. 9. Will the action result in public service requirements such as provision of utilities or safety services which, because of the location or scale of the development, cannot be provided on an economic basis and therefore would create an actual burden to the public? • No, the proposed rezoning would not result in public service requirements that could create a burden on the public. Any potential infrastructure improvements related to this rezoning would be the responsibility of the property owner and would not place a burden on the City.
