June 24, 2025 – On Tuesday, the Metropolitan Planning Commission will consider a petitioner’s request for a zoning map amendment to construct a 3-story building with a ground floor restaurant with five upper story residential units on a vacant lot at 312 East 38th St.
The property owner, Stoteswold Group LLC, intends to open a second location in the commercial portion for their twice-baked-potato restaurant, Spudnik, according to the application.
So far, the proposed rezoning from Traditional Neighborhood to Traditional Commercial has received one letter of support and one letter of opposition from area residents.
Jason Combs said he supports the creation of housing units at higher densities where there are such infill opportunities.
“We are in a housing crisis, and every little bit helps,” Combs said. “Every neighborhood of every city needs to do what it can to increase housing density.”

Virginia Mobley said is not opposed to mixed-use but is opposed to the proposed rezoning because it could allow uses such as a reooming house and allow for buildings of a larger mass and scale.
“While current uses being discussed is a restaurant that is mainly take-out, with apartments above, the zoning changes last years and building can be converted to any commercial use allowed,” Mobley said. “The expanded building size allows for higher density in an already tight block with a multi unit residential and a commercial use building all using street parking.”

Staff is recommending approval after finding the zoning amendment supports several of the city’s planning goals regarding housing, land use and community development.
“The requested Traditional Commercial designation complements these objectives by promoting vibrant, walkable neighborhoods that integrate residential and commercial uses,” the staff report states.
